Legal dispute between EL, BWD postponed

LISBON - A new court hearing date of Jan. 24 has been scheduled in the seven-year-old legal dispute between East Liverpool and the Buckeye Water District.

A motions hearing scheduled for Dec. 10 in Columbiana County Common Pleas Court was canceled after one of the attorneys became ill. The case was continued until the two sides could agree on a new hearing date.

The hearing was on a motion by BWD that asks Judge C. Ashley Pike to enforce a settlement agreement that would pay East Liverpool $5.9 million to resolve the city's successful breach-of-contract lawsuit against the BWD.

The $5.9 million represents what East Liverpool said in April it would accept from the BWD to resolve the lawsuit, and BWD agreed, but the city later changed its mind in July by adding other conditions, and the two sides have continued sparring in court ever since.

The $5.9 million includes the $4.8 million East Liverpool was awarded for winning its lawsuit against the BWD, plus interest. East Liverpool is saying is now wants another $700,000 in interest it is entitled to collect.
