Couple sues over energy leases

LISBON - A Salineville couple filed a lawsuit this week in Columbiana County Common Pleas Court against the Ohio and Pennsylvania Coal Co. and other energy partners, including Chesapeake Exploration, requesting the release of any leases on the title to property in Franklin Township.

The initial lease through the Ohio and Pennsylvania Coal Co. was for coal and minerals under the surface and signed in 1872 by Daniel and Nancy McGarry and J.R. and S.M. Conrad. Additional deeds were issued in 1907 and 1941.

Additionally, an oil and gas lease was executed in February 2011 by Jeffrey and Linda Weekly, however, the plaintiff's claim neither the Weeklys nor Patriot Energy Partners, Chesapeake Exploration, Tug Hill Minerals, Total E and P USA Inc. or Dale Pennsylvania Royalty LP have a valid interest to the resources other than coal.

The plaintiffs, Jedidiah and Emily Coldwell of Salineville, have requested the declaration of any claims by the defendant to the real estate or gas and oil on the property be released.

The Ohio and Pennsylvania Coal Co. is no longer in existence, and the plaintiffs are disputing that the other companies have claims to those leases.
