Wrongful death lawsuit filed against East Fairfield Coal Co.

YOUNGSTOWN - A wrongful death lawsuit was filed this week against East Fairfield Coal Co. in North Lima.

The civil suit seeking more than $1 million was filed in Mahoning County Common Pleas Court by Karen A. Harris, who is handling the estate of Jason E. Gudat.

Gudat was employed by the company when he was killed on April 25, 2011, while working in an underground Petersburg limestone mine owned by Fairfield Coal. He was 31 and a resident of Washingtonville.

He died after being hit in the chest with a rock at about 1:30 a.m. He was wearing a hard hat. His death was the first accident of its kind in the company's history, according to previous reports.

The suit seeks more than $25,000 in compensatory damages and more than $1 million in punitive damages. It also demands a jury trial which has been assigned to Judge James C. Evans.
